Approve Minutes from last meeting

In the matter of approving the Minutes from the October 19, 2021 Business Meeting. - BOCC

Background: Approve the Minutes which summarize all business by the Board of Commissioners for the Business Meeting held on the date stated above.

Fiscal Impact: None

Recommended Motion: Approve the Minutes as presented.

Orders

1.

In the matter of vacating Lots 1 and 3 of Running Y Resort Phase 1, Tract 1319. Map No. R-3808-009A0 Tax Lots: 00600. Erik Nobel, Planning

Background:  The property owner of the two lots are Robert and Sheri Townsend who have signed a petition requesting this action.  Vacating the lots will not be detrimental to the public.  The Planning Director’s Report recommends that the two lots be vacated from the subdivision. The applicant paid the $583 application fee to process the request to vacate the lots.  Approval of the final order by the Board of Commissioners has no fiscal impact to the county.

 Fiscal Impact:   There is no fiscal impact to Klamath County.

 Recommended Motion:   Approve the Final Order to vacate the above described property located in Klamath County Oregon. (File No. LV 20-21).  There is no fiscal impact to Klamath County. 

2.

In the Matter of the Authorization for the Treasurer to make advance payments to taxing districts with $100,000 or less taxes assessed. Vickie Noel - Treasurer

Background: The attached list of districts are relatively small districts and the monthly distribution they would receive would be minimal.  This makes them very expensive for Klamath County to process.  ORS 311.392 allows the County to pay in advance, removing the districts and increasing the county’s percentage so the county will be reimbursed for the money advanced.  If done prior to December 1st, the county may deduct from the advance 3 percent that would have been given if the taxes were paid by November 15th. 

Fiscal Impact: $1,372,277.84 Advance Expenditure from the County General Fund

Recommended Motion:  Approve the attached Order authorizing the Treasurer to advance tax payments to those districts with $100,000 or less in assessed value.  Fiscal impact to the County General Fund is an advance payment of $1,372,277.84.

Agreements

1.

In the matter of approving Intergovernmental Security and Access Agreement 172638 between the State of Oregon, Oregon Health Authority (OHA), and Klamath County, acting by and through Klamath County Public Health (KCPH). – Jennifer Little, Public Health

Background:  Agreement 172638 grants KCPH access to a SharePoint portal which will support the triennial review process for the WIC and overall Public Health fiscal reviews. The reviews are now completed in an entirely remote setting and SharePoint facilitates the sharing of documents required for these reviews. Fiscal reviews require large documents that are not conducive to email with size limitations. This agreement will establish a process for the secure transfer of documents, which will create a simpler and more fluid experience. The agreement is effective until terminated. 


Fiscal Impact:  No fiscal impact


Recommended Motion: Intergovernmental Security and Access Agreement 172638 between the State of Oregon, Oregon Health Authority (OHA), and Klamath County, acting by and through Klamath County Public Health (KCPH). No fiscal impact. Authorize the Department Head to sign.

In the matter of approving the Tobacco Retail License, Information Sharing, and Enforcement Agreement between the State of Oregon, acting by and through the Oregon Department of Revenue and Klamath County, acting by and through Klamath County Public Health (KCPH). – Jennifer Little, Public Health

Background: In 2017 Klamath County passed a a local tobacco retail license (TRL), Ordinance 90.01, and Klamath County Public Health has been implementing the TRL program since. During the 2021 legislative session, Senate Bill 587 was passed, which requires all tobacco retailers in Oregon to have a license. The new law allows local jurisdictions with TRL ordinances to continue as is but require data sharing with the state. The data includes a roster of licensees and inspection results. The agreement remains effective from the date fully executed by all parties to the date it is terminated by operation of law.


Fiscal Impact:  No fiscal impact  


Recommended Motion:  Move to approve the Tobacco Retail License, Information Sharing, and Enforcement Agreement between the State of Oregon, acting by and through the Oregon Department of Revenue and Klamath County, acting by and through Klamath County Public Health. No fiscal impact. Authorize the Department Head to sign.

7.

Library Service District

1.

In the matter of increasing the impress cash account within the Klamath County Library Service District. Vickie Noel - Treasurer

Background:  Since the impress cash account was revised in 2013 to total $400.00, the Library has increased the amount of printing and copying materials for patrons.  They routinely have issues making change for these activities and, therefore, are requesting an impress cash account increase to $490.00. 

Fiscal Impact:  $90.00 Increase in impress cash fund in the Klamath County Library Service District.

Recommended Motion:  Approve and sign the attached resolution increasing the Klamath County Library Service District impress cash account from $400.00 to $490.00.  Fiscal impact is an increase of $90.00.
