In the matter of approving the Minutes from the September 22nd, 2020 Business Meeting. - BOCC

Background: Approve the Minutes which summarize all business by the Board of Commissioners for the Business Meeting held on the date stated above.

Recommended Motion: Approve the Minutes as presented.

In the Matter of the Klamath County Veterans Service Office and Oregon Department of Veterans Affairs pass-through funding Kathleen Pierce-Veterans

Background:  Every year the Veterans Service Office receives funding from the ODVA to be used for Outreach, Advertising, Klamath Lake Stand down, Pay for Assistant District Attorney for Veterans Court.

Fiscal Impact:  114,490.00 Revenue to the Grants-State in Aid

Recommended Motion:  Read for the record.  The motion to approve the Veterans Service Office to apply and receive pass-through funding from the Oregon Department of Veterans Affairs and authorizing the Chair to sign the application was approved and signed September 1, 2020 at the Administrative Meeting.  Fiscal Impact for 20/21 revenue of $114,490.00

In the Matter of Proclaiming the week of October 5, 2020 as Modoc Ancestral Run Week in Klamath County, Oregon. - BOCC

Bids/Awards/Proposals

1.

In the matter of accepting the quote and executing the notice of award to Gage-it Construction for Guardrail Supply and Installation for the replacement of the W Langell Valley Rd/West Canal Bridge 18C011. Jeremy Morris, Public Works

Background:  On August 12, 2020 Public Works requested written quotes for Guardrail Supply and Installation for the replacement of the W Langell Valley Rd/West Canal Bridge 18C011 project.  The following quotes were received:

Gage-it Construction $15,650.00
Coral Construction $33,555.00

Public Works requests that the quote be awarded to Gage-it Construction for $15,650.00.

Fiscal Impact:  Fiscal Impact is none.

Recommended Motion:  Board to accept the quote and execute the attached Notice of Award to Gage-it Construction for Guardrail Supply and Installation for the replacement of the W Langell Valley Rd/West Canal Bridge 18C011. Fiscal impact is none.

Agreements

1.

In the matter of approval and allowing the director to sign an amendment between Klamath Lake Community Actions Services (KLCAS) and Klamath County Community Corrections to provide burnable fire wood for KLCAS’s energy assistance clients. Aaron Hartman, Community Corrections.

Background: Community Corrections’ work crews have provided burnable firewood for energy assistance clients in Klamath County for many years. This contract allows for citizens of Klamath County to receive firewood through the KLCAS and the Oregon Low Income Energy Assistance Program. Both parties acknowledge and agreed implementation date may be prior to signature date. This amendment will extend the contract from October 1, 2020 – September 31, 2021. The state of Oregon is in the process of drafting all new contract language to take effect October 1, 2021 at which time a new contract will be created between KLCAS and Community Corrections.

Fiscal Impact: Revenue shall not exceed $7,000 to the Community Corrections Operating Funds Account. 

Recommended Motion: Motion to approve and allow the director to sign an amendment between Klamath Lake Community Actions Services (KLCAS) and Klamath County Community Corrections to provide burnable fire wood for KLCAS’s energy assistance clients. Fiscal Impact: Revenue shall not exceed $7,000 to the Community Corrections Operating Funds Account.
2.

In the matter of signing a 20 year Payment in Lieu of Taxes (PILOT) Agreement with Rogue River Holdings, LLC, an Oregon Limited Liability Company. Nathan Bigby Klamath County Assessor

Background: Rogue River Holdings, LLC will build a 2.7 megawatt solar photovoltaic system located at R-4112-01600-01300-000. The facility will consist of ground mounted solar modules. Solar facilities are low impact in terms existing county resources, and will bring tax benefits to Klamath County.  The fee in lieu of taxes shall be $7,000 multiplied by the rated nameplate capacity of the project measured in MWac beginning FY2022/2023.

Fiscal Impact: The project revenue is $3,780 per year and $75,600 over the life of the agreement to the general fund (non departmental) in the projects current capacity.

Recommended Motion: That the Klamath County Board of Commissioners approves and signs the attached Payment in Lieu of Taxes Agreement with Rogue River Holdings, LLC. The projected revenue is $3,780 per year and $75,600 over the life of the Agreement in the projects current capacity.

Licenses

1.

In the matter of approving a recommendation for a renewal liquor license for Crazy R Pizza, Hanscam’s Bowling Center, Crater Lake Junction Travel Center, Playhouse Tavern, Greensprings Market, Jo’s Motel & Campground, Lien’s Store, Mac’s Store, Mohawk Restaurant, Mr. B’s Steakhouse, My Store in the Woods, Rocky Point Resort, Wubba’s BBQ Shack and Midland Family Market. - BOCC

Background: The Oregon Liquor Control Commission (OLCC) verifies that each tavern/store has met the necessary conditions to sell liquor.  The County’s position is a recommendation only and the OLCC may take the recommendation into consideration before granting or refusing the license.

Fiscal Impact: Revenue of $10.00, for each renewal license, to the General Fund Commissioners. 

Recommended Motion: Note for the Record.

Orders

1.

In the matter of appointing Linda Smith, Andrew Stuedli and Michael Long to the Board of Property Tax Appeals. - BOCC

Background: Pursuant to ORS 309.067 the Board of Commissioners appoints two pools of individuals to serve on the Board of Property Tax Appeals (BOPTA).  Pursuant to ORS 309.020 the County Clerk recommends Andrew Stuedli and Linda Smith to Pool One, Governing Body’s Designee and Michael Long to Pool Two, Nonoffice-holding residents.  All individuals are eligible and willing to serve a term on the Board commencing this day and continuing until June 30, 2021.  They will complete the training for returning members provided by the State of Oregon Department of Revenue.

Fiscal Impact: None.

Recommended Motion:  Approve and sign the attached Order appointing Andrew Stuedli and Linda Smith to Pool One, governing body’s designee and Michael Long to Pool Two, nonoffice-holding residents.

In the matter of appointing Rick Sonerholm and Debra Gisriel to the Klamath Housing Authority Board. - BOCC

Background: The Klamath Housing Authority Board has vacancies and has recommended the appointment of the above-named individuals who are willing able and eligible to serve a term on the Board commencing this day and expiring July 31, 2024.

Fiscal Impact: None.

Recommended Motion:  Approve and sign the attached Order appointing Rick Sonerholm and Debra Gisriel to the Klamath Housing Authority Board.
